Terms of Service

Privacy Protection and Data Removal Services

Please read these Terms of Service carefully before using Encovert’s services. By subscribing to or using any Encovert service, you agree to be bound by these terms.

1. Services

Encovert LLC (“Encovert,” “we,” “us”) provides done-for-you privacy protection and data removal services for individuals whose personal safety depends on keeping their information off the internet. Encovert primarily serves law enforcement officers, attorneys, judges, prosecutors, federal agents, parole officers, and other high-risk professionals, but services are available to any qualifying adult. Services include data broker removal, Google and Bing de-indexing, government record suppression assistance, voter registration suppression, and related privacy protection activities as described in your selected plan.

2. Eligibility

Encovert services are available to any adult who wishes to protect their personal information online. Encovert primarily serves law enforcement officers, attorneys, judges, prosecutors, federal agents, parole officers, and other high-risk professionals, but does not restrict or verify professional credentials at signup. By subscribing, you represent that you are at least 18 years of age and are legally authorized to enter into this agreement.

You agree to provide accurate information during account creation and onboarding. Encovert reserves the right to terminate accounts found to be created with fraudulent or intentionally misleading information.

2b. Minors

Encovert does not knowingly collect personal information from individuals under 18 years of age. If you are under 18, you may not use our services. If we learn that personal information has been collected from a minor, we will delete it promptly.

3. Subscription Plans

Encovert offers the following subscription plans:

  • Basic Plan ($39/month): Covers one individual. Includes data broker removal across 635+ sites, Google and Bing de-indexing, voter registration suppression, spam call reduction, and quarterly privacy report.
  • Elite Plan ($64/month): Covers one individual plus one family member. Includes all Basic features plus property tax record suppression, driver’s license alternate address guidance, vehicle VIN scrubbing, online presence audit, and monthly check-in with your privacy specialist.

Plan features are subject to change with 30 days written notice to subscribers.

4. Authorization

By subscribing, you authorize Encovert to act as your agent for the purposes described in your signed Limited Power of Attorney. Encovert will not take actions outside the scope of your signed authorization.

5. Payment

Subscriptions are billed monthly on the date of initial signup. Payment is processed securely through Stripe. You authorize Encovert to charge your payment method on a recurring monthly basis until your subscription is canceled. If a payment fails, Encovert will notify you and may suspend service until payment is resolved.

6. Results and Limitations

Encovert will use good faith, reasonable efforts to provide removal services, but there is no guarantee or warranty of any kind that data brokers or third-party sites will honor or comply with removal requests. It is not possible to remove 100% of your personal information from all sources. Data brokers operate independently and may re-list information after removal. Encovert will continue to monitor and re-submit removal requests as part of ongoing service. It can sometimes take weeks or months for third parties to remove information from their systems. Results will vary based on the volume and nature of a client’s online exposure.

7. Confidentiality

Encovert treats all client information with strict confidentiality. We do not sell, share, or disclose client data to third parties except as required to deliver the services described (e.g., submitting removal requests on your behalf) or as required by law.

8. Client Responsibilities

You agree to provide accurate and complete information during onboarding. You agree to complete required authorization steps in a timely manner. Delays caused by incomplete information or failure to complete onboarding steps may affect service delivery timelines.

9. Intellectual Property

All Encovert branding, materials, reports, and content are the property of Encovert LLC. You may not reproduce, distribute, or use Encovert materials without written permission.

10. Limitation of Liability

Encovert’s liability to you shall not exceed the total fees paid in the three months preceding any claim. Encovert is not liable for any indirect, incidental, or consequential damages arising from the use of our services or the actions of third-party data brokers or organizations.

11. Governing Law

These Terms of Service are governed by the laws of the State of Texas. Any disputes shall be resolved in Travis County, Texas.

12. Changes to These Terms

Encovert reserves the right to update these Terms of Service at any time. Subscribers will be notified by email at least 30 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the updated terms.

Privacy Policy

How Encovert Collects, Uses, and Protects Your Information

Encovert LLC is committed to protecting the privacy of every client. We serve individuals for whom privacy is a matter of personal safety, including law enforcement officers, legal professionals, judges, and other high-risk professionals. Privacy is not just a policy at Encovert. It is the foundation of everything we do.

1. Information We Collect

To deliver our services, we collect the following information from clients:

  • Full legal name
  • Current and previous home addresses
  • Date of birth
  • Phone number and email address
  • Known aliases or name variations
  • Payment information (processed and stored securely by Stripe; Encovert does not store card numbers)
  • Signed Limited Power of Attorney
  • Any additional information provided during onboarding

2. How We Use Your Information

Your information is used exclusively to deliver Encovert’s privacy protection services, including:

  • Submitting data removal and suppression requests to data brokers on your behalf
  • Requesting de-indexing of your information from search engines
  • Submitting government record suppression requests where applicable
  • Generating your quarterly or monthly privacy reports

We do not use your information for marketing, analytics, or any purpose outside the delivery of your subscribed services.

3. Information We Do Not Share

Encovert does not sell, rent, or share your personal information with any third party for commercial purposes. Your information is never used to train AI models, shared with advertisers, or disclosed to any party outside of what is strictly necessary to deliver your services.

4. Limited Disclosure

The only circumstances under which Encovert may disclose client information are:

  • To data brokers and third-party sites solely for the purpose of submitting removal requests on your behalf
  • To our backend service providers under strict confidentiality agreements
  • As required by valid legal process, court order, or applicable law

In all cases, disclosure is limited to the minimum information necessary.

5. Website Tracking and Cookies

Encovert’s website may use cookies and standard web analytics tools to understand how visitors use the site. This data is aggregated and anonymous and is not linked to your personal client information. You may disable cookies through your browser settings at any time.

6. Data Security

Encovert uses industry-standard security practices to protect your information, including encrypted storage, secure communications, and access controls. Client files are accessible only to authorized Encovert personnel. We take the security of our clients’ data with the highest level of seriousness.

7. Data Retention

We retain your information for as long as your subscription is active and for a reasonable period thereafter as required for legal and operational purposes. Upon written request following account cancellation, we will delete your personal information from our systems within 30 days, except where retention is required by law.

8. Your Rights

You have the right to request access to the information Encovert holds about you, request corrections to inaccurate information, and request deletion of your information following account cancellation. To exercise any of these rights, contact us at support@encovert.com.

9. Texas Residents — TDPSA Rights

If you are a Texas resident, the Texas Data Privacy and Security Act (TDPSA), Tex. Bus. & Com. Code § 541 et seq., effective July 1, 2024, grants you the following rights with respect to your personal data:

  • Right to Know: You may confirm whether Encovert is processing your personal data and request access to that data.
  • Right to Delete: You may request that Encovert delete personal data it has collected about you. Requests will be honored within 45 days, with one 45-day extension if reasonably necessary.
  • Right to Correct: You may request that Encovert correct inaccurate personal data it holds about you.
  • Right to Opt Out of Sale: Encovert does not sell your personal data. No opt-out action is required.
  • Right to Data Portability: You may request a portable copy of your personal data in a reasonably usable format.
  • Right to Non-Discrimination: Encovert will not discriminate against you for exercising any of your TDPSA rights.

To submit a request under the TDPSA, contact us at support@encovert.com from your verified account email address. We will respond within 45 days. If we are unable to fulfill your request, we will explain why in writing. You may appeal a denial by replying to our response email. If your appeal is denied, you may contact the Texas Attorney General at texasattorneygeneral.gov.

10. Changes to This Policy

Encovert may update this Privacy Policy from time to time. Subscribers will be notified by email before material changes take effect. Continued use of the service constitutes acceptance of the updated policy.

Cancellation & Refund Policy

Subscription Services

Encovert offers flexible month-to-month subscriptions with no long-term commitment required. This policy explains how cancellations and refunds are handled.

1. Cancellation

You may cancel your Encovert subscription at any time with no cancellation fee and no questions asked. To cancel, log in to your client portal and navigate to the Billing tab, or contact us directly at support@encovert.com.

Cancellations take effect at the end of your current billing period. You will retain full access to your account and services through the last day of the paid period. No further charges will be made after cancellation is confirmed.

2. 30-Day Money-Back Guarantee

Encovert offers a full 30-day money-back guarantee on your first purchase, no questions asked. If you are not satisfied within 30 days of your initial signup, contact us at support@encovert.com and we will issue a full refund.

How to Request a Refund

1. Cancel your subscription through the Billing tab in your client portal or by emailing support@encovert.com.

2. Send your refund request to support@encovert.com with the email address on your account.

3. Your full refund will be processed within 5–10 business days.

The 30-day guarantee applies to first purchases only. Multiple refund requests from the same client will not be honored. Refunds are not available after the 30-day window has passed.

3. No Partial Refunds After 30 Days

After the 30-day guarantee window, partial refunds for unused days within a billing period are not available. Subscriptions run through the end of the billing cycle regardless of when cancellation is requested.

4. Billing Errors

If you believe you have been charged incorrectly or there is an error in your billing, contact us immediately at support@encovert.com. Encovert treats billing errors as a top priority and will resolve any confirmed error as quickly as possible.

5. Failed Payments

If a scheduled payment fails, Encovert will notify you by email. If payment is not resolved within 5 business days, your account may be suspended. Suspended accounts can be reactivated by updating your payment information in the client portal. Encovert is not responsible for any gap in service caused by a failed payment.

6. Plan Changes

You may upgrade or downgrade your plan at any time through your client portal or by contacting support. Upgrades take effect immediately and are prorated for the remainder of the billing period. Downgrades take effect at the start of the next billing period.

Data Security Statement

How Encovert Protects Your Personal Information

When you sign up for Encovert, you are trusting us with some of the most sensitive personal information you have. We take that seriously. This page explains the practices we use to protect your data.

1. Who Has Access to Your Data

Access to client data at Encovert is strictly limited to authorized personnel who need it to deliver your services. No employee, contractor, or third party may access client records outside of their defined role. Access is reviewed regularly and revoked immediately upon any change in role or relationship with Encovert.

2. Data Transmission

All data transmitted between you and Encovert is encrypted in transit using TLS (Transport Layer Security). This includes your onboarding information, portal communications, and any documents you upload or receive.

3. Data Storage

Client data is stored in access-controlled environments. Sensitive files, including signed authorization documents and personal identifiers, are stored separately from general account data with additional access restrictions. Encovert does not store payment card numbers. All payment processing is handled by Stripe, which maintains PCI DSS compliance.

4. Account Authentication

Client portal accounts are protected by secure magic link authentication. Login links are single-use, time-limited, and sent only to your verified email address. No passwords are stored. We recommend clients maintain access to a secure, private email account associated with their Encovert profile.

5. Vendor Security

Where Encovert uses third-party vendors to deliver services, those vendors are selected in part based on their security practices. Encovert does not share client data with any vendor beyond what is strictly necessary to fulfill your service, and all vendors handling personal data operate under confidentiality obligations.

6. Incident Response

In the event of a security incident that may affect your personal data, Encovert will notify affected clients promptly and take immediate steps to contain and remediate the issue. Notification will be sent to your account email address.

7. Physical Security

Encovert operates as a remote-first company. No physical client files are maintained. All records are digital and subject to the access controls and encryption standards described above.

8. Ongoing Commitment

Security is not a one-time checklist at Encovert. It is an ongoing operational priority. We review our practices regularly and update them as our platform grows and as threats evolve.
